7. Legal basis of processing

Article 6 (1) (a) GDPR respectively Article 9 (2) (a) GDPR serves as the legal basis for our company for processing operations in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of any other service or consideration, the processing is based on Article 6 (1) (b) GDPR.

The same applies to such processing operations that are necessary for the implementation of pre- contractual measures, for example in the case of enquiries about our products or services. If our company is subject to a legal obligation by which the processing of personal data becomes necessary, such as for the fulfilment of tax obligations, the processing is based on Art. 6 (1) (c) GDPR.

In some cases, the processing of personal data might become necessary in order to protect the vital interests of the data subject or another natural person. In this case, the processing would be based on Art. 6 (1) (d) GDPR.

In addition, processing operations could be based on Article 6 (1) (f) GDPR. Processing operations which are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject are not overridden. We are permitted to carry out such processing operations because they were specifically mentioned by the European legislator. In this respect, the legislator took the view that a legitimate interest could be assumed if the data subject is a customer of the controller (recital 47, second sentence GDPR). If the processing of personal data is based on Article 6 (1) (f) GDPR, our legitimate interest is the performance of our business activities for the benefit of all our employees and our shareholders.

8. International transfers

We may transfer your Personal Information to other countries than the one in which you live in connection with storage and processing of such information, fulfilling your requests and operating the Service. By providing us with your Personal Information you consent that we can transfer such information under the terms of this Policy and applicable data protection laws and regulations.

Some countries may not have the same data protection framework as the country from which you may be using the Service. When we transfer the Personal Information, we will protect it as described in this Policy. We will comply with applicable legal requirements providing adequate protection for the transfer of personal information. We shall deploy European Union Standard Contractual Clauses if we transfer the Personal Information originating from the European Union to other countries not deemed adequate under applicable data protection law. We will not transfer health-related personal information to other countries except upon your request (e.g. when you want to access these data outside of the country from which you created the account). In the sense of previous statement, European Union is considered equivalent to a country.

9. Retention of information

We retain the user data for as long as the User’s account is active, as these data are necessary for the account to be operational. After 2 years of inactivity, the user account will be disactivated automatically, and the personally identifiable user data will be deleted, unless their retention is required by law. This may include keeping your Other Information after you have deactivated your account for the period of time needed for us to pursue legitimate business interests, conduct audits, comply with (and demonstrate compliance with) legal obligations, resolve disputes and enforce our agreements. Patient’s data will be retained for 5 years since their submission. After this period, the patient’s personally identifiable data will be deleted.
